Uncontested Divorce Cases
While no divorce is truly “uncontested” in the sense there are no disagreements, disputes do not always have to be resolved in Court. That’s what we mean by an uncontested divorce – one where the spouses can reach an agreement as to the terms of the divorce without going to trial.
From the very beginning, parties must understand that our firm cannot represent both you and your spouse. As attorneys, we can only represent one spouse – not both – in order to prevent any conflict of interest.
Our uncontested divorce packages are handled on a flat-fee basis. The level of involvement and fees depend on the specific facts and circumstances of your case.
All of our clients complete a thorough Divorce Questionnaire. Once we have sufficient information, we draft the documents that must be
filed with the court, and have the client review and sign the documents.
The fee for basic uncontested divorce representation is $1,750. The assumption is made that you and your spouse have no property, no children and that neither of you will paying alimony to the other.
This service includes the consultation following receipt of your Questionnaire, preparation of all the documents to file with the court, and an appearance by one of our lawyers on behalf of the firm at a final hearing. Our fee DOES NOT include filing fees or court costs.

Because there are additional steps in the divorce process, more extensive drafting or additional pleadings may need to be prepared. If additional work is requested, fees for Additional Services shall be charged. At the time that you retain our firm, you will know exactly how much your case will cost, including additional filing fees or other costs.
Additional Services
The following is a list of additional work, along with definitions and fees associated with each:
- Real Estate: If you and your spouse own real estate (commercial or residential buildings, homes, condominiums, apartment buildings, or land, etc.), additional drafting work is needed for your Separation Agreement. Therefore, an additional charge of $100 for each piece of property will be added to the basic fee.
- Children: If you and your spouse have any children together, because of the extra court documents and drafting, there is an additional $100 added to your basic fee. Note: This includes our Basic Parenting Plan & calculation of the Child Support Guidelines. Learn About our Premium Parenting Plan
- Alimony Provision: If you and your spouse agree to spousal support payments, an additional fee of $100 is added to the basic fee.
- Qualified Domestic Relations Order: If either you or your spouse has retirement benefits to be divided between you, we charge an additional fee of $50 per plan to oversee the drafting, in which case we utilize the services of financial professionals.
- Premium Parenting Plan: In Massachusetts, parties must submit a parenting plan to the court for its consideration. A comprehensive parenting plan sets forth details regarding the child’s education, health care, procedures for resolving disputes between the parties with respect to child-raising decisions and duties, and the periods of time during which each party will have the child reside or visit with him or her (including a Holiday Schedule). Let us help you with the process of creating a Premium Parenting Plan. Giving you more than 100 options and alternatives, we take the guesswork out of co-parenting after divorce. You’ll feel at ease knowing that you’ve consistently made the best decisions possible. A well-constructed Parenting Plan (Custody Agreement) can save you thousands of dollars in legal fees, protect the “best interest” of your child, and help you avoid courtroom battles. An additional $250 is added to your basic fee.
- Premium Separation Agreement: A separation agreement is a legal contract between spouses that addresses the division of property and debts, as well as any child support, alimony, custody and parenting issues. The agreement is filed with the court and is enforceable by the Judge. Our Premium Separation Agreement – often as long as 25 pages – leaves no doubt about how your divorce issues will be handled. Your agreement will address additional issues such as post-secondary education, tax provisions, and other important points. When you invest in our Premium Separation Agreement, the Premium Parenting Plan is included at no additional charge. For those seeking the protection of our best Separation Agreement, an additional $350 is added to your basic fee.
- Missing Spouse: If you cannot locate your spouse, you may still be able to obtain an uncontested divorce. In order to proceed with your divorce, however, you have to obtain a court order allowing you to serve your spouse by publication. An additional fee of $250 is required, plus costs and disbursements. Note: There is an additional three-month waiting period required by Massachusetts statute.
- Parties Out-of-State: If you live out of state or move from Massachusetts during your proceeding, there will be an additional $100 fee due to extra communication.
- Changes to Divorce Agreement: There is a $100 additional charge each time you request changes after first sending us your Divorce Questionnaire.
- Changes to your Financial Statement: You will be charged an additional $50 for changes to your Financial Statement following your first set of revisions.
- Additional Consultations: You will be charged an additional $250 for each conference (whether in person or on the telephone) beyond our initial meeting.
- Missed Office Appointment: $100 each
- Rescheduling of Court Appearance: $100 per reschedule
- “Get Your File at the Courthouse” Service: For post-divorce matters, we find that our new clients are too busy at work to make trips to the courthouse to get their file. We’ll do it for you…just add an additional $250 to your basic fee.
- Expedited Processing*: Our standard turnaround time for uncontested divorce representation is one month. Should you want faster service, we offer the following option as an add-on provision:
- Two-Week Divorce: $250
- 72-Hour Divorce: $500
*Subject to statutory law and Judicial scheduling
What’s NOT Included:
Our services do not include the negotiation of a Separation Agreement, changes to a Separation Agreement adding or deleting items that were not included in your original request, or the preparation of any post-divorce documents such as Qualified Domestic Relations Orders (QDRO). Our Massachusetts Flat-Fee Divorce Attorneys do not review any defined benefit pension or retirement documents or render legal advice regarding said benefits. We won’t draft or file any temporary motions, conduct any discovery, transfer title or property, change estate planning investments or documents, or prepare for trial. Finally, our rates do not include the filing fee for your case or the cost of the parenting class (only required if you have minor children). Our attorneys work with you in order to create a workable Separation Agreement between you and your spouse. We draft all the necessary pleadings and edit your financial statement. Once everything is in order, we conduct a final review and approve the documents for filing. If we’re representing you, we file everything, schedule your court date and let you know when and where to appear. One of our attorneys represents you on the day that you get divorced.

Self-Help Legal Services
A La Carte Legal Assistance
If you’re like most people going through a divorce, you’re exhausted. You want somebody else to take charge and take care of you. You want somebody else to negotiate for you, tell you how to behave, and tell you where to sign the Separation Agreement.
When you opt for this type of “A La Carte” service, you can pick-and-choose what you need from your attorney:

This option provides you with the safety net of legal oversight and advice, but doesn’t drain your bank account in the process. This arrangement requires the signing of an agreement with our law firm and provides you with the assurance of both a confidential and fiduciary relationship. An hourly rate of $250 to $325 per hour plus any expenses is billed for all work, and a $975 deposit is required to start.

Divorce Paperwork Service
We have come across a number of people who have attempted to prepare their divorce or post-divorce documents on their own. Usually, they spend several hours at the Courthouse and untold hours trying to draft the documents. Since a divorce case is somewhat complex no matter how simple, they usually end up spending a world of time that produces incorrect documents. In the end, they come to us to fix it. With our Divorce Paperwork Service, you get your divorce on a budget but you don’t give up help from a divorce attorney.
The preparation of forms in the Massachusetts Probate & Family Court is very complicated and attorneys have the most recent forms on computer programs which insure that the form is completed correctly and that all necessary forms are filed. It is not uncommon for the parties representing themselves to not have the correct forms and for a filing to be rejected by the court. While this even happens to every attorney at some time, it happens more often with those who are representing themselves as the forms are complex and more than one form is often required to be filed for many stages of the divorce process. Failure to file the correct forms can result in not obtaining the relief you are asking for.
Here’s how it works:
- First, if you’re proceeding on a new divorce matter, you will take less than a half-hour to fill out our Divorce Questionnaire. Even completing the Questionnaire, you will feel just as if you were talking to a lawyer. If there’s been a change of circumstances, and you’re filing modification documents, simply report what’s changed since the last court order.
- You’ll answer specific questions about your marriage, the goals of your divorce, settlement points such as parenting issues, alimony and child support, property and debt division, etc. Note: If you answer any question in a way that could raise a problem in court, you’ll be automatically alerted to the potential problem.
- Our staff handles all the paperwork, preparing Massachusetts divorce papers specifically tailored to your case. That means you can arrange your settlement the way you want it, for results you’ll be satisfied with.
Our simple and inexpensive process will enable you to complete your Divorce Paperwork by delegating the work to us, while you focus on staying calm from the comfort of your own home or office without incurring the high cost of legal representation. Divorce Consultation
In divorce consulting, you are in control of much of your divorce proceedings, and you only employ the services of an attorney when you need him or her. It is an option for someone who needs specific assistance only with certain areas of the divorce and allows you control over much of the proceedings. Our divorce lawyers and family law attorneys are great coaches, offering you a leg up without charging you an arm and a leg. You’ll pay for the time you actually use – in 45-minute blocks – no more, no less. You’ll pay on the spot, meaning you don’t have any long-term commitment. As a matter of comfort, we will provide you with an Agreement which assures you of our confidential and fiduciary relationship.
Here’s how it works:
- We host the conference at any of our offices, or we pay for the call anywhere in the world!
- We charge you $250 for the 45-minute conference or phone call. We’ll take your credit card over the telephone or when you get to our office. You get one-on-one, uninterrupted time to ask any questions to which you will get straight answers for. Your time won’t start until we’ve gotten all the credit card stuff out of the way.
- All the information discussed will remain confidential. You may call us once and never again, or you could call us periodically whenever you think we can be helpful.
