REQUIRED DOCUMENTS 

In order to file a Joint Petition for Divorce under Massachusetts General Laws Chapter 208 Section 1A, both parties must have come to a written agreement on all divorce issues.  Furthermore, the following is required:

1. Joint Petition for Divorce: The Joint Petition for Divorce is the document in which you and your spouse are asking the court to grant the divorce along with any other relief requested. 

2. Joint Affidavit in Support of Complaint for Divorce:  This document is used to state that the allegations contained in the Petition are true, and that a judgment may be entered according to the information stated in the Petition, Separation Agreement and Decree.

3. Separation Agreement:  This document provides for the final distribution of any assets and debts of the parties and any other matters reached between the parties.  The Agreement must be signed by both parties with each signature notarized.   

4. Financial Statements:  This document is used to identify the income and expenses and the assets and debts of the parties. This form may only be used if the party completing the form has an annual income of less than $75,000. 

5. Statistical Information Form R-408:  This form is required and will be checked by the Clerk.

6. Certified Copy of Your Marriage Certificate:  You must get this from the town/city where you were married.  A copy will not be accepted.

7. Affidavit Disclosing Care or Custody:  If there are any minor children of the marriage, you must file this form.

8. Certificate of Attendance:  For divorces with minor children, each parent must attend an approved Parent Education Program before the case can be assigned for hearing.

9. Child Support Guidelines Worksheet:  This must be presented to the Judge for approval relating to any child support order.
