First, do you or your spouse live in Massachusetts?
With very few exceptions, our firm can help divorce almost anyone in the Commonwealth of Massachusetts who either lives here or who has a spouse that lives here through an uncontested divorce. Secondly, do you and your spouse agree upon all of the issues associated with divorce?
If you do, you are well on your way to meeting the requirements for an uncontested divorce. Think about it – it’s called uncontested because there are no contested disputes between you and your spouse.
Just to be safe, double-check: You must have discussed – and agreed upon – all of the issues and all of the details that will result in each of your final divorce obligations.

All of the assets –
the house, the items in the house, retirement investments, vehicles, and even your pets – are considered marital assets. Have you decided how to divide your
property and debts?

If children are involved, the terms of your
custody and parenting must be agreed to, along with the amount of
child support that one of you will be paying to the other. All of these issues have to be agreed upon.

If you and your spouse have children, an uncontested divorce is ideal if you want to minimize the effects that divorce has on children. Attorney Irwin M. Pollack believes that most parents can co-parent even though they’re no longer a couple. The third – and final – question to answer is whether or not you’re comfortable with our firm and our style?
The honest truth is each of our attorneys knows what types of clients do well with our firm. Our team excels when working with clients who think strategically, want to save time and money, while avoiding a big hassle.
We also recognize when a potential client won’t be happy with us. For example, if you and your spouse are yelling and bickering with each other, you’ll never get through the uncontested process. Sure, we’ll refer you to the second floor to our contested lawyers who know the Judges, clerks, local procedures and customs of each of Massachusetts’ 14 county Probate and Family Courts, but if you and your spouse are at war – you won’t do well pursuing an uncontested action.
You may also be disappointed if you insist on having us represent both you and your spouse – because we won’t do it! Ethically, we cannot. At all times, we must know which of you is our client and which of you is not. Sure, the non-client can call and ask questions on agreed-to, procedural issues, but our loyalty is to our client first.
